similarly encoded files - stuttering differences

So I have two files - one stutters severly on my XBOX360 and one plays smoothly. And you can observe the differences if you play one straight after another so this is probably not due to wirless router interference.
I can not tell what is different about these two files. The ffmpeg -i result for them are below. They really seem pretty nearly identicle in properties. The one that does not stutter is encoded at a slightly HIGHER bit rate than the one that does stutter.
